Question : 33
Consider the following statements and select the correct answer from the codes given below:
- Assertion (A): Collective responsibility of the Cabinet signifies unity and coordination among members of the Council of Ministers.
- Reason (R): It is the prerogative of the Prime Minister to select or drop a member of the Cabinet.
a) Both A and R are individually true but R is not the correct explanation of A
b) A is true but R is false
c) Both A and R are individually true and R is the correct explanation of A
d) A is false but R is true
Answer »Answer: (a)
The collective responsibility under Article 75 of the Constitution of India has two meanings:
- All members of a Government are unanimous in support of its policies,
- The ministers, who had an opportunity to speak for or against the policies in the cabinet are thereby personally and morally responsible for its success and failure.
The prime minister selects and can dismiss other members of the cabinet; allocates posts to members within the Government; is the presiding member and chairman of the cabinet and is responsible for bringing proposal of legislation.
Question : 34
Consider the following: The president appoints
- Governors of States
- The Chief Justice, other judges of the Supreme Court and High Courts of India
- The Attorney General
- The Comptroller and Auditor-General
- The Chief Election Commissioner and other election commissioners
- The Chairman and other members of the Union Public Service Commission
- Ambassadors and high commissioners to other countries
a) 1, 2, 3, 5 and 6
b) 1, 3, 4, 6 and 7
c) 2, 4, 5 and 7
d) 1, 2, 3, 4, 5, 6 and 7
Answer »Answer: (d)
The President appoints, as Prime Minister, the person most likely to command the support of the majority in the Lok Sabha (usually the leader of the majority party or coalition).
The President then appoints the other members of the council of ministers, distributing portfolios to them on the advice of the Prime Minister. The council of ministers remains in power during the ‘pleasure’ of the President. In practice, however, the Council of Ministers must retain the support of the Lok Sabha.
If a President were to dismiss the Council of Ministers on his or her own initiative, it might trigger a constitutional crisis. Thus, in practice, the Council of Ministers cannot be dismissed as long as it commands the support of a majority in the Lok Sabha.
